This privacy policy (“Policy”) describes how The Iteration LLC (“Epiphany” or “Company”) collects, uses, protects and shares Personal Information of users of this website, www.epiphanyvoice.io (the “Site”) and the Epiphany voice note sharing app (the “App”). We will refer to the Epiphany App and Epiphany Site collectively as the "Service".

Epiphany is a productivity service that allows you to share voice notes with yourself and others. To provide Epiphany, we collect your "Personal Information," which is information that directly or indirectly relates to you. We store the Personal Information that we need to operate our Service to help you be more productive.

This Policy applies to anyone who accesses the Service. By visiting the Site and/or using the App, you acknowledge that the collection, use, and sharing of your information will take place as described in this Policy.

WHAT WE COLLECT & HOW WE USE IT

We respect your information and our goal is to collect as little user information as possible while still providing a quality service to you.

We won't try to profit from your privacy. We don't sell your Personal Information and we don't use your Personal Information to show you third-party ads.

We receive and store information about you in a range of ways and the information you provide to us varies depending on your purpose in interacting with our Services.

Most guests of our site provide information in the following ways:

Information You Give Us.

We collect basic account information: your‎ name, email address, email settings, username, password, profile information, accessibility information, as well as other information you directly give us so that we can provide Services to you.

We may collect and store the content you create, including voice and note messages ("Epiphany Messages"). We store this Personal Information on our servers so that you can access your Epiphany Messages anytime from any of your devices that have the Epiphany App without having to rely on third-party backups or use up your phone's memory.

Our servers are located in the United States. Depending where you or people you are communicating with are located, data may travel through secure networks outside of the United States.

Information We Get From Others. We may get information about you from other sources to further customize your experience, like updating the website based upon your location information. We may add this to information we get from you.

Information Automatically Collected. We automatically log information about you and your devices. For example, when using our Services, we log IP address, date and time of access, location information, browser information, operating system information, device identification information, and information about your use of and actions on our Site. While you use our Services, we also collect information related to how you interact with us, such as your path through our website, and your frequency of use of the App. This information allows us to update our services and learn how we can better tailor the Services to serve you. Finally, we may receive information from you, like a confirmation, when you open emails from us. This confirmation helps us make our communications with you more interesting and helps us improve communications.

Cookies. We may log information using “cookies.” Cookies are small data files stored on your hard drive by a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site. You have a choice about whether or not you wish to receive information from us. If you do not want to receive communications from us about our products and services, then you can request that communications stop by contacting Epiphany at privacy@epiphanyvoice.io. You have a choice to rectify at any time your Personal Information by contacting Epiphany support at privacy@epiphanyvoice.io. You have a choice to delete all data associated with your Epiphany account by heading to your Account page.

SHARING OF PERSONAL INFORMATION

We do not sell or trade your Personal Information with others. We may share Personal Information as follows with third parties and Service Providers:

• We may share Personal Information with your consent. For example, you may let us share Epiphany Messages with others at your request through Service Providers or directly to others.

• We may share aggregate or anonymous data (data that has had personally identifying characteristics, like your name or address) with third parties for advertising purposes or as part of providing our Services

• We may share Personal Information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.

• We may share Personal Information for legal, protection, and safety purposes:

o We may share information to comply with laws.

o We may share information to respond to lawful requests and legal processes.

o We may share information to protect the rights and property of Epiphany, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.

o We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.

• We may share information with those who need it to do work for us.

THIRD PARTY PAYMENT SERVICES AND ANCILLARY SERVICES

We rely on third parties to process credit card transactions and do not collect or store your credit card details. That information is provided directly to our third party payment processors and that collection is governed by their Privacy Policy.

We work with third parties to provide some of our Service ("Service Providers"). Service Providers will have access to your Personal Information needed to perform their business functions, but may not use or share that Personal Information for purposes outside the scope of their functions related to the Service. This includes Service Providers who help with technical and hosting support; security and fraud management; transcription services; sending SMS, email, and in-app notifications; supporting features of the Service; user analytics; and customer feedback and support. Depending on the Service Provider, we may share information you provide, including your contact information and Epiphany Message, and technical information we automatically collect from your devices, such as information about your usage of our Service.

If you are outside the United States, we share your Personal Information with certain third-party providers in the United States, and such transfers are subject to appropriate safeguards.

STORAGE OF INFORMATION

Your information collected through the Services is processed in the country in which Epiphany service providers maintain facilities. If you are based in the United States and use our Site, you consent to have your data processed by Epiphany in the United States. International clients have differing needs based on their country of origin and we provide custom storage and processing solutions to meet those requirements.

Epiphany maintains strict administrative, technical and physical procedures to protect information processed via our servers. Access to information is limited (through user/password credentials and two factor authentication) to those employees who require it to perform their job functions. We use industry-standard technology, including but are not limited to data encryption, firewalls, VPN, physical access controls to safeguard the information we collect from you.

We maintain your information while you have an account for our Services. When we no longer require your information to maintain your account, we will delete it. If you choose to make an account deletion request, we will permanently and irreversibly delete all of your personal data information from our systems, including all Epiphany Messages. Once deleted, your data, including your account and activities cannot be reinstated for your Site account. To make an account deletion request, email us at privacy@epiphanyvoice.io.

INFORMATION CHOICES AND CHANGES

Our marketing emails tell you how to “opt-out.” If you opt out, we may still send you non-marketing emails. Non-marketing emails include emails about your accounts and our business dealings with you.

You may send requests about Personal Information to our Contact Information below or to privacy@epiphanyvoice.io. You can request to change contact choices, opt-out of our sharing with others, and update your Personal Information through your Account profile or through contacting us at privacy@epiphanyvoice.io.

We mentioned above that you can make choices about cookies. You can typically remove and reject cookies from our Site with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Site works for you.

Certain state laws may provide you with additional rights regarding our use of your Personal Information. If you are a resident of California, Colorado, Connecticut, Utah or Virginia, the following provisions provide notice about your consumer privacy rights:

INFORMATION WE COLLECT

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”). In particular, we have collected the following categories of Personal Information from consumers within the last twelve (12) months:

• Identifiers. We collect some identifiers, such as your name, internet protocol address, postal address, email address, telephone number or other similar identifiers so that we may communicate with you.

• Characteristics of protected classifications under California or federal law. California and federal laws provide protection against discrimination if you belong to a protected class. Under California law, certain Personal Information in this category may be considered sensitive. Protected classes include groupings based on race, ethnicity, or national origin; religious or philosophical beliefs; sexual orientation; genetic information; family status; and whether you have a disability. We do not ask you to provide this information to us and we do not knowingly store data that contains this information, but if your Epiphany Messages include information that includes this Personal Information, we will collect and store this at your request.

• Commercial information. We collect and maintain a record of your transactions with Epiphany. We disclose this information to our Service Providers for business purposes, such as processing the transaction you have requested. While do not collect financial information like your credit card information or credentials allowing access to an account, under California law, certain Personal Information in this category may be considered sensitive.

• Biometric information. Under California law, biometric information includes any physiological or behavioral characteristics that can be used to establish your identity, such as a voice recording. Under California law, certain Personal Information in this category may be considered sensitive. We collect your voice recordings to provide Services to you.

• Internet or other electronic network activity information. Epiphany collects certain information about user activity on our electronic networks, such as how consumers interact with our websites and apps. We use this information to help determine what pages or features are popular or where our products and services could be improved. We may also use such information for marketing purposes with your consent or other applicable legal basis.

• Geolocation data. Under California law, precise geolocation data means any data that is derived from a device and that is used or intended to be used to locate a consumer within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet. Under California law, certain precise geolocation data is considered sensitive. We do not ask you to provide this information to us and we do not knowingly store data that contains this information, but if your Epiphany Messages include information that includes this Personal Information, we will collect and store this at your request.

• Audio, electronic, visual, thermal, olfactory, or similar information. Epiphany does not collect information about your senses.

• Professional or employment-related information. We do not ask you to provide this information to us and we do not knowingly store data that contains this information, but if your Epiphany Messages include information that includes this Personal Information, we will collect and store this at your request.

• Education information. We do not ask you to provide this information to us and we do not knowingly store data that contains this information, but if your Epiphany Messages include information that includes this Personal Information, we will collect and store this at your request.

• Inferences from your Personal Information to create a profile about your preferences. If you choose to personalize your services or communications where such an option is available, Epiphany will use information that we collect so that we can offer you those personalized services or communications.

Sensitive Information

The California Consumer Privacy Act requires that we tell you whether we collect any Personal Information that is described in California Civil Code Section 1798.80(e). The Code section includes a broad variety of categories of Personal Information, such as name, contact information, education, employment, medical information, credit card or billing information, and more. Under California law, certain Personal Information in this category, such as religious beliefs, union membership, sex life, social security number, precise geolocation, and health information, may be considered sensitive. We do not ask you to provide this information to us and we do not knowingly store data that contains this information, but if your Epiphany Messages include information that includes this Personal Information, we will collect and store this at your request.

Sources of Collection

We obtain the categories of Personal Information listed above from the following categories of sources:

• Directly from you. For example, through information we ask from you when you register with for our Services.

• Directly and indirectly from you when using our Services or visiting our Site. For example, usage details collected automatically in the course of your interaction with our Site or by providing Epiphany Messages.

USE OF PERSONAL INFORMATION & USE OF SENSITIVE INFORMATION

We may use or disclose the Personal Information we collect for one or more of the following business purposes:

• To provide you with email alerts and other notices concerning updates to our Site.

• To improve our Site.

• As necessary or appropriate to protect the rights, property or safety of us, our users or others.

• To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

• As described to you when collecting your Personal Information or as otherwise set forth in the CCPA or CPRA.

• To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

STORAGE OF INFORMATION

Your Personal Information and sensitive information collected through the Services is maintained as long as you maintain an account. We maintain your information and your Epiphany Messages for a period of time.

We will delete all of your personal data if you request us to do so by emailing us at privacy@epiphanyvoice.io. During this process, we will need to maintain some of your information for legal purposes, but once we no longer require your information to maintain your account, we will delete it within three months after your request to delete your account. Generally, we store your information and your Epiphany Message for approximately 12 months (the “Storage Period”). However, if you choose to delete your Epiphany Messages, these will be permanently deleted and no longer accessible. Epiphany Messages that exceed the Storage Period will be permanently deleted from our servers.

Epiphany maintains strict administrative, technical and physical procedures to protect information and Epiphany Messages collected by the Services from unauthorized access, destruction, use, modification or disclosure. Access to information is limited (through user/password credentials and two factor authentication) to those employees who require it to perform their job functions. We use industry-standard technology, including but not limited to data encryption and physical access controls to safeguard the Personal Information and Epiphany Messages we collect from you.

SHARING PERSONAL INFORMATION

We do not sell or trade your Personal Information with others, but we do connect our Service Providers to you and provide some Personal Information, namely your name, email address, and a selected Epiphany Message at your request. If you do not want Personal Information shared with Service Providers, do not chose this option.

We have written agreements with all of our Service Providers that have access to your Personal Information that require everyone with access to your Personal Information to maintain it securely and confidentially.

We may disclose your Personal Information to a third party for a business purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of collected Personal Information for a business purpose:

• Identifiers, such as your name, email address, or other similar identifiers.

• Biometric Information, specifically voice recordings at the request of users.

We disclose these categories of Personal Information for a business purpose to the following categories of third parties:

• Service Providers.

In the preceding twelve (12) months, we have not sold any Personal Information. However, as described in this Privacy Policy, we do provide your information at your request to our Service Providers at your request to provide Services to you.

YOUR RIGHTS AND CHOICES

Your privacy choices are important to us and we would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

The right to opt out – You have the right to opt out of the sale of your data we have collected, the right to opt out of the collection and use of your data for targeted advertising, and the right to opt out of the processing of your personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning a customer. We do not sell your data or engage in targeted advertising but you may request to opt out of the sharing of your data in this manner by sending us a request.

The right to access – You have the right to request Epiphany disclose what Personal Information it collects, uses, discloses or sells. Once we receive and confirm your verifiable consumer request, we will disclose to you:

• The categories of Personal Information we collected about you during the past 12 months.

• Our business or commercial purpose for collecting that Personal Information.

• The categories of third parties with whom we share that Personal Information.

• The specific pieces of Personal Information we collected about you (also called a data portability request).

Epiphany does not sell your Personal Information for monetary compensation. However, as described in this Privacy Policy, we do provide your information at your request to our Service Providers. Under some circumstances a transfer of Personal Information to a third party without monetary consideration may be considered a “sale” under California law.

The right to correction or rectification – You have the right to request that Epiphany correct any information you believe is inaccurate. You also have the right to request Epiphany to complete the information you believe is incomplete. Our correction and completion of information is limited to personal data collected over the last 12 months and does not include game, tournament, or challenge data or information.

The right to data portability – You have the right to request that Epiphany transfer the Personal Information data that we have collected to directly to you under certain conditions.

The right to erasure – Some state residents also have the right to request the deletion of their Personal Information collected or maintained by Epiphany. Once we receive a request for deletion and confirm your verifiable consumer request, we will delete the Personal Information (to the extent required by law) we hold about you as of the date of your request from our records. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your Personal Information, you may not be able to use certain website functions that require your Personal Information to operate.

You have 3 choices for your erasure of your information:

• You may choose to opt out of the sale and sharing your Personal Information;

• You may choose to limit the use of your sensitive Personal Information;

• You may choose to request that we not sell or share your Personal Information for cross-context behavioral advertising.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

1. Complete the transaction for which we collected the Personal Information or take actions reasonably anticipated within the context of our ongoing business relationship with you.

2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

4. Comply with the state law.

5. Comply with a legal obligation.

6. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Verifying Requests Access, Data Portability, and Deletion Rights

Only you or a person registered with your Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your Personal Information or complying with your request.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. If you make more requests in a year, we may require a fee to process your additional requests.

The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. In addition, if you ask us to provide you with specific pieces of Personal Information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request. If you designate an authorized agent to make an access, deletion or opt-out of sale request on your behalf (a) we may require you to provide the authorized agent written permission to do so, and (b) for access and deletion requests, we may require you to verify your own identity directly with us.

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

If you make a request, we have 45 days to respond to you.

We will not discriminate against you for exercising your rights. This means we will not deny you service, charge different prices or rates, provide a different level of service, or suggest that you might receive a different price or level of quality for service. Please know, if you ask us to delete your information or stop transferring your information, it may impact your experience using our Services.

VISITORS FROM OUTSIDE OF THE UNITED STATES

We mention above that the Services collect and store data on services hosted in the United States and our headquarters is in the United States. If you are visiting the Site or using the Services from outside the United States, information we collect about you will be transferred to, stored and processed in the United States in accordance with this Policy and applicable U.S. laws.

Please note that data protection and other applicable laws of the United States may differ from the data protection or consumer protection laws in your country. By using the Service, you acknowledge and consent to transfer of your information to our facilities as described in this Policy.

For our international customers, any questions or concerns regarding the collected information, use or disclosure of your information should be directed to privacy@epiphanyvoice.io. Once we receive and confirm your verifiable consumer request, we will investigate and attempt to resolve complaints and disputes regarding use and disclosure of your information in accordance with this Privacy Policy.

CHILDREN

Our Services are not directed to children under 13 and we do not knowingly collect personally identifiable information directly from children. Please contact us at privacy@epiphanyvoice.io if you believe we have inadvertently collected Personal Information from a child under 13 so that we may delete such data as soon as possible.

The Services and our business may change from time to time. As a result, at times it may be necessary for Epiphany to make changes to this Privacy Policy. Epiphany reserves the right to update or modify this Privacy Policy at any time and from time to time. We will notify you by email (sent to the e-mail address specified in your Account) or by means of a notice on this Site of any material changes to this Privacy Policy. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.
